Terms of Service

1. Acceptance
By accessing or using hubello ("Service"), including via our website, web applications, or any mobile or other applications that incorporate or link to these Terms, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The Service may be used internationally. You must comply with all applicable local, state, national, and international laws in your jurisdiction and in any place where the Service is used. Certain sections below refer to specific jurisdictions (e.g. EU, UK, Canada, Australia, United States) where relevant to consumer rights, content moderation, or dispute resolution; your statutory rights in your country of residence are not waived where the law does not permit.
2. Description of Service
hubello provides software and a platform for managing short-term rental properties, cleaning and other tasks, bookings, team members, calendar synchronization, contracts, and related operations. Depending on your subscription and our product offerings, we may also provide tools for you to prepare or publish property information (e.g. descriptions, amenities, photos, and availability derived from your Hubello calendar) that could be displayed on a website or page intended to promote your rental to the public. We may add, change, or discontinue features with reasonable notice where practicable. The Service may be made available through our website or through third-party platforms (e.g. app stores); your use remains subject to these Terms.
3. Owner listing pages, marketing tools, and independent rental relationships
The following applies to any feature that lets you display property information to prospective guests outside your authenticated Hubello workspace (including, without limitation, optional “public listing,” “marketing page,” or similar tools we may offer now or in the future).
hubello does not manage, broker, or operate your rentals for the public
hubello is not your rental agent, property manager, real estate broker, travel agency, booking intermediary, marketplace operator, or payment collector for stays that you arrange directly with guests. We provide software and hosting infrastructure so you can present information about your property. Any rental relationship, negotiation, pricing, payment, deposit, cancellation, dispute, damage claim, insurance, or tax obligation arising between you and a guest or prospective guest is solely between you and that person, except where you separately use other Service features (for example, contracts or payment-term flows offered inside Hubello for your operational choices), which remain subject to the rest of these Terms.
No guest booking fees or rental proceeds through hubello for direct bookings you arrange
Unless we expressly agree otherwise in writing for a specific paid product, hubello does not charge guests a commission on, nor take a percentage of, rent or other amounts you agree with a guest outside of Hubello’s own subscription or stated software fees. You keep 100% of the booking revenue and fees you collect from guests under your own arrangements (subject only to fees charged by your own bank, payment provider, or government). Fees you pay hubello (e.g. subscription) are separate from your rental income and are not “booking fees” on your guests.
Your responsibilities for listing content and compliance
You are solely responsible for: the accuracy and legality of all information you enter or publish (including descriptions, amenities, photos, address, and availability); compliance with short-term rental, advertising, consumer protection, anti-discrimination, tax, licensing, and insurance requirements in every jurisdiction where you operate or market; obtaining rights to text and images you upload; honoring any promises you make to guests; and screening or verifying guests. hubello does not verify listing accuracy, guest identity, or local regulatory compliance for your public-facing content.
No guarantee of visibility, leads, or bookings
We do not guarantee any minimum level of traffic, search ranking, inquiries, or bookings from any listing or marketing feature. Availability or calendar information displayed to the public is derived from data you maintain in the Service and may be subject to delays or errors; you remain responsible for correct communication with guests.
Inquiries and contact forms
If we offer contact or inquiry forms for visitors, hubello may transmit information submitted through those forms to you so you can respond. You are responsible for your own privacy notices and lawful handling of guest and prospective guest data once received. Our collection and processing of such submissions are described in our Privacy Policy.
4. Accounts and Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate and complete information when registering and keep it updated. One person or legal entity may not maintain more than one account for the same role (e.g. one owner account) unless we agree otherwise.
5. Acceptable Use
You agree not to use the Service for any illegal purpose or in violation of any applicable laws in your country or the countries where the Service is used (including local, state, national, and international law). You may not use the Service to: harass, abuse, defame, threaten, or harm others; to distribute content involving the sexual exploitation or abuse of minors, or that facilitates human trafficking, in violation of laws such as those in Canada (Criminal Code), the United States (e.g. federal and state CSAM and trafficking laws), the European Union and UK (e.g. Digital Services Act, Online Safety Act), Australia (eSafety framework), or other jurisdictions; to promote violence, self-harm, hate speech, or illegal discrimination; to transmit malware or interfere with the Service or others' systems; to attempt to gain unauthorized access to the Service, other accounts, or our or our providers' networks; to scrape or automate access in a way that violates our systems or policies; or to resell or sublicense the Service except as we expressly permit. We may suspend or terminate access for conduct that we reasonably believe violates these Terms or is harmful to others or the Service, and we may report content or conduct to authorities where required by law.
6. Content and Message Moderation
To keep the Service safe and to comply with legal obligations, we may monitor, scan, or review message content and other user-generated content (e.g. in-app chat, direct messages, and public listing or marketing copy you submit where we host it). We may use automated tools and, when content is flagged, manual review by authorized personnel. We may remove content, suspend or terminate accounts, and report to law enforcement or other authorities as required or permitted by applicable law—including under regimes such as the EU Digital Services Act, the UK Online Safety Act, United States federal and state laws (e.g. regarding child safety and trafficking), the Canadian Criminal Code, the Australian Online Safety Act, and similar laws in other countries. How we process message content for safety is described in our Privacy Policy (see "Message Moderation and Safety"). By using the Service, you consent to such processing in accordance with our Privacy Policy and these Terms.
7. Fees and Payment
Some parts of the Service may be subject to fees (e.g. subscriptions or one-time charges). When payment is required, we will describe the fees and billing terms before you are charged. By providing a payment method, you authorize us (and our payment processors) to charge that method for agreed fees. Fees are in the currency stated at the time of purchase. We may use third-party payment processors (e.g. Stripe); their terms and privacy policies may also apply. We reserve the right to change fees with advance notice for future billing periods; continued use after the change constitutes acceptance unless you cancel.
Fees you pay to hubello are for access to our software and platform only. They are not guest rent, booking fees on behalf of travelers, or commissions on rental income you earn when you deal directly with guests (see Section 3).
Subscriptions and auto-renewal
Paid subscriptions (e.g. monthly or annual) renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel through your account settings or our customer portal (e.g. subscription management link we provide). Cancellation will take effect at the end of the current billing period; you will not be charged for the next period. We do not provide refunds for partial periods. If you subscribed through a third party (e.g. Apple App Store or Google Play), cancellation and billing are governed by that platform's rules.
Free trials
We may offer free trials (e.g. a 14-day trial). Unless otherwise stated, at the end of the trial we may charge your payment method for the first paid period unless you have cancelled. You may cancel at any time during the trial to avoid being charged.
8. Refunds and Cancellation
Refund and cancellation terms for paid features are stated at the time of purchase or in a separate payment/refund policy. Unless otherwise stated, subscription fees are non-refundable for the period already paid. You may cancel a subscription before the next billing date to avoid future charges. For refund requests, contact us at service@hubello.net; we will process eligible requests in accordance with our stated policy and applicable law. If you are in a jurisdiction that mandates refund rights (e.g. certain consumer protection laws), those rights remain available to you.
9. Intellectual Property
The Service and its content (including software, design, text, and graphics, but excluding your data) are owned by hubello or our licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service or our content without our prior written permission. You retain ownership of content you submit to the Service; you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process that content as necessary to provide and improve the Service and as described in our Privacy Policy. That license includes displaying property descriptions, images, amenities, and similar materials you provide on pages or experiences we operate to promote your property to the public, for so long as you use the feature and subject to your settings.
10. Contracts and Document Features
The Service allows you to create, send, and manage contracts and related documents (e.g. rental agreements, house rules, payment terms) for your properties and bookings. This section applies to all such contract and document features.
Not legal advice; no attorney-client relationship
hubello is not a law firm. The contract templates, fields, and any text or structure we provide are for general educational and informational purposes only. They do not constitute legal advice. No attorney-client relationship is created between you and hubello. The content is provided by non-lawyers and should not be relied upon as a substitute for advice from a qualified lawyer in your jurisdiction. For any legal questions or for documents that affect your rights or obligations (including rental, real estate, or employment matters), you should consult a licensed attorney before using the documents.
As-is disclaimer for templates and documents
Contract templates and document features are provided "as is" without any warranties of accuracy, suitability, completeness, or reliability. We do not warrant that any template or generated document is appropriate for your situation, compliant with local law, or legally enforceable. Laws vary by jurisdiction and change over time; we do not update or tailor templates for every jurisdiction or use case.
User responsibility and assumption of risk
You assume full responsibility for your use of the contract and document features and for any risks arising from that use. You are solely responsible for ensuring that any document you create, send, or rely on is accurate, complete, and appropriate for your circumstances and complies with applicable law. We strongly recommend that you have a lawyer review any contract or legal document before using it, especially for high-risk or high-value matters (e.g. real estate, rentals, employment, or significant financial terms).
hubello not responsible for contracts
To the maximum extent permitted by law, hubello and its affiliates, officers, directors, employees, and agents are not responsible or liable for: (a) the content, enforceability, or legal effect of any contract or document you create or send using the Service; (b) any loss, damage, or claim arising from the use or reliance on such contracts or documents; or (c) any failure of a document to achieve its intended purpose or to comply with local law. Your use of the contract features is at your own risk.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF USERS OR THIRD PARTIES, OR FOR THE ACCURACY OR RELIABILITY OF USER-GENERATED CONTENT OR OF ANY CONTRACTS OR DOCUMENTS CREATED OR SENT USING THE SERVICE (SEE SECTION 10), OR FOR ANY PUBLIC-FACING LISTING, MARKETING PAGE, OR SIMILAR TOOL (SEE SECTION 3). HUBELLO DOES NOT WARRANT THAT ANY LISTING WILL ATTRACT GUESTS OR GENERATE INCOME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN SUCH CASES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUBELLO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR YOUR USE OF IT, INCLUDING BUT NOT LIMITED TO ANY USE OF THE CONTRACT OR DOCUMENT FEATURES (SECTION 10), ANY DISPUTE BETWEEN YOU AND A GUEST OR PROSPECTIVE GUEST, OR ANY LOSS ALLEGEDLY ARISING FROM A PUBLIC LISTING OR MARKETING PAGE (SECTION 3). THIS APPLIES WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR RENT, DEPOSITS, OR FEES YOU DID OR DID NOT COLLECT FROM GUESTS. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD 100), WHICHEVER IS GREATER. SOME JURISDICTIONS (INCLUDING CERTAIN CANADIAN PROVINCES) DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless hubello and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any law; (c) your violation of any third-party right; (d) any content or data you submit or that is submitted through your account; or (e) any rental, marketing, pricing, discrimination, tax, licensing, safety, or guest-relations claim connected to your property or any public or guest-facing information you publish or cause to be published through the Service (including inquiries or bookings you handle outside hubello). We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you; you will cooperate with us in asserting any available defenses.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, for non-payment, or for any other reason with or without notice where permitted by law. You may stop using the Service and close your account at any time (e.g. through account deletion as described in the Service). Upon termination, your right to use the Service ceases immediately. We may retain or delete your data as described in our Privacy Policy and in accordance with applicable law.
15. Governing Law and Dispute Resolution
hubello is a Canadian-based company. These Terms are governed by the laws of Canada and the Province of Ontario, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of such courts. This choice of law and forum does not prevent us from seeking injunctive or other relief in any jurisdiction to protect our intellectual property or confidential information.
If you are a consumer in Quebec, the European Union, the United Kingdom, or another jurisdiction that provides for mandatory consumer protection (e.g. choice of law or forum for consumers), nothing in these Terms affects your statutory rights under the laws of your province or country of residence.
16. Third-Party Platforms (Apple, Google, and others)
If you access or obtain the Service through a third-party platform (e.g. Apple App Store or Google Play):
- These Terms are between you and hubello, not between you and Apple, Google, or any other platform. The platform has no obligation to provide maintenance or support for the Service.
- To the extent permitted by applicable law, the platform has no warranty obligation, and any claims relating to the Service (e.g. product liability, failure to conform to legal requirements) are our responsibility, not the platform's.
- If you subscribed or paid through the platform, the platform's payment and refund policies apply to those transactions; we are not responsible for the platform's billing or refund decisions.
- You represent that you are not located in a country that is subject to a Canadian or U.S. Government embargo or designated as supporting terrorism, and that you are not listed on any Canadian or U.S. Government list of prohibited or restricted parties.
Where the platform's terms conflict with these Terms with respect to your use of the Service, these Terms will govern to the extent of the conflict, except where the platform's terms are required to apply (e.g. by the platform's distribution agreement) and cannot be varied by contract.
17. General
Entire agreement: These Terms, together with our Privacy Policy and any additional terms we provide for specific features, constitute the entire agreement between you and hubello regarding the Service and supersede any prior agreements.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms or your account without our consent. We may assign our rights and obligations without restriction.
18. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-app notice where required by law or where we deem it appropriate. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service. We encourage you to review this page periodically.
